1. Definitions

  • Provider: Het Strategiebureau, provider of the Beleidsmonitor.
  • Service: the Beleidsmonitor, including all registers, dashboards, analyses, notifications and modules.
  • User: the natural person who holds an account and uses the Service.
  • Customer: the consumer or business with whom the agreement is concluded.
  • Consumer: a user who is not acting in the course of a profession or business.
  • Account: the personal, non-transferable access to the Service.
  • Subscription: the paid, ongoing agreement for access to the Service.
  • Trial period: the free period preceding the first payment.
  • Database: the whole of the data collected, organised and enriched by the Provider.

2. Applicability

These terms apply to every offer, every registration and every agreement relating to the Service.

Deviating terms of the Customer are expressly rejected, unless the Provider has accepted them in writing.

In addition to these general terms and conditions, the Subscription terms, the Privacy statement, the Cookie statement, the Acceptable Use Policy and the Refund and cancellation policy apply. In the event of conflict, the Subscription terms prevail over these general terms and conditions.

3. Account and registration

An account is strictly personal. Registration takes place as a business user or as a private user; the information requested must be accurate and complete.

The user sets their own password, verifies the email address and activates two-factor authentication. Access is only granted once these steps have been completed.

The user is responsible for keeping login details confidential and for all use that takes place via the account.

4. Business users and consumers

Business users register with company name, position, business email address, address details and, where applicable, Chamber of Commerce (KvK) number and VAT number.

Consumers have additional statutory rights, including the right of withdrawal as described in the Refund and cancellation policy. Provisions in these terms that limit these rights do not apply to consumers.

5. Digital service and availability

The Service is offered as a digital service via the internet. The Provider makes every effort to ensure good availability, but does not guarantee uninterrupted availability.

Maintenance, further development and changes in source systems may lead to temporary limitations.

6. Prices, taxes and payment

All prices are in euros and exclusive of VAT, unless expressly stated otherwise. The applicable VAT rate is shown at checkout.

Payment is made via Stripe. On registration, a payment method is registered and authorised. No charge is made during the trial period.

At the end of the trial period, the chosen subscription is activated automatically and the amount is collected automatically, unless cancelled before the end of the trial period.

If a payment fails, access may be suspended until the payment has been made.

7. Stripe as payment service provider

Payments are processed by Stripe. The Provider does not itself receive or store complete payment details; these are recorded directly with Stripe.

Stripe's terms and privacy policy apply to processing by Stripe.

8. Intellectual property and database right

All intellectual property rights in the Service, the software, the design, the texts and the Database are vested in the Provider.

The user receives a non-exclusive, non-transferable and revocable right of use for their own use within their own organisation, solely for the duration of the subscription.

The Provider is the maker of the Database within the meaning of the Dutch Databases Act (Databankenwet). Extracting or re-utilising a substantial part of the Database is not permitted. See the Database rights page.

9. Use of AI analyses

The Service uses automated analysis and AI to classify, summarise and connect documents.

AI analyses are a tool. The original source remains authoritative. No rights can be derived from analyses and they do not constitute legal advice.

10. Modules and subscriptions

The Service consists of a basic subscription and optional modules. Which components are accessible follows from the chosen subscription and the modules purchased.

The Provider may further develop the composition of modules and the functionality, provided the core of the purchased subscription is maintained.

11. Term and cancellation

The subscription is entered into for the chosen period and is then automatically renewed for the same period.

You can cancel online at any time via the account page. Cancelling during the trial period prevents any payment.

After cancellation, access continues until the end of the period already paid for.

12. Liability

The Provider is not liable for damage arising from inaccuracies or incompleteness in third-party sources.

The Provider's liability is limited to the amount paid for the Service in the twelve months preceding the event causing the damage, except in the case of intent or deliberate recklessness.

This limitation does not apply to the extent that mandatory consumer law precludes it.

13. Force majeure

The Provider is not obliged to perform in the event of force majeure, including outages at hosting or source parties, network outages, cyberattacks and government measures.

14. Changes

The Provider may change these terms. In the event of a material change, the user will be informed and asked for renewed consent on next use. Previous versions remain available for consultation.

15. Applicable law and disputes

All agreements are governed by Dutch law.

Disputes are submitted to the competent court in the Netherlands. For consumers, the court with statutory jurisdiction applies.
